These Terms & Conditions (“Terms”) govern your use of the services provided by Elevated Wellness Performance & Fitness (“Company,” “we,” or “us”) located at 7903 S Loop E, Houston, TX 77012. By using our services or submitting any form on our website, you agree to these Terms.
Membership and Services
Membership fees are billed on a monthly basis. Cancellation requires written notice per the terms of your membership agreement. All services are subject to availability and may be modified or discontinued at the Company’s discretion with reasonable notice.
SMS Terms of Service
By opting in to SMS text message communications from Elevated Wellness Performance & Fitness, you agree to the following terms:
- Message types. You may receive two categories of SMS messages: (1) Transactional/Informational messages, including appointment reminders, membership and account updates, billing notifications, and customer care responses; and (2) Promotional/Marketing messages, including special offers, event announcements, and wellness promotions.
- Message frequency. Transactional message frequency depends on your appointment schedule and membership activity. Promotional message frequency will not exceed 4 messages per month unless otherwise disclosed at the time of opt-in.
- Message and data rates. Standard message and data rates charged by your mobile carrier may apply to all SMS messages sent and received. Check with your carrier for details.
- Opting out (STOP). You may opt out of SMS messages at any time by replying STOP to any message from us. Upon receipt of STOP, we will send one final confirmation message and you will be removed from all SMS lists. You may opt back in at any time by contacting us.
- Help. For assistance, reply HELP to any message or contact us at (346) 833-8589 or info@elevatedwellness-pf.com.
- Carrier liability. Carriers are not liable for delayed or undelivered messages. Message delivery is not guaranteed, and Elevated Wellness Performance & Fitness is not responsible for messages delayed or undelivered due to circumstances beyond our control.
- No third-party sharing. SMS opt-in data and consent information will not be shared with, sold to, or transferred to any third party for marketing purposes.
- Supported carriers. SMS services are available on all major U.S. carriers including AT&T, T-Mobile, Verizon, and others. Availability may vary by carrier and plan.
Assumption of Risk and Liability Waiver
Participation in fitness, wellness, and clinical services involves inherent risks of injury. By using our services, you acknowledge those risks and agree to hold Elevated Wellness Performance & Fitness, its owners, employees, and agents harmless from any claims, damages, or injuries arising from your participation, to the fullest extent permitted by law.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes shall be resolved in Harris County, Texas.
Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after any change constitutes your acceptance of the revised Terms.
