ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY

In consideration of being permitted to participate in any way in the programs, activities, services, and use of the facilities and equipment of Elevated Wellness Performance & Fitness, LLC ("Elevated Wellness"), located at 7903 S Loop E, Houston, TX 77012, I, the undersigned, acknowledge, agree, and represent that:

1. ASSUMPTION OF RISK. I understand that fitness activities, exercise programs, clinical therapies (including but not limited to rTMS, IV therapy, hormone therapy, hyperbaric oxygen therapy, red light therapy, regenerative medicine, and all associated treatments), and use of equipment and facilities involve inherent risks of injury, illness, or death. I voluntarily and knowingly assume all such risks, both known and unknown, including but not limited to: muscle strains, sprains, tears, fractures, heart attacks, stroke, or other physical or medical conditions.

2. WAIVER AND RELEASE. To the fullest extent permitted by applicable law, I hereby waive, release, and forever discharge Elevated Wellness Performance & Fitness, LLC, its officers, directors, employees, agents, contractors, trainers, clinical staff, and representatives (collectively, "Released Parties") from any and all claims, demands, injuries, damages, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me in connection with participation in any activity at the facility or use of any equipment or services therein.

3. INDEMNIFICATION. I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, costs (including reasonable attorney fees), liabilities, judgments, causes of action, damages, or demands of any nature arising from or in connection with my participation in programs, activities, or use of facilities and services at Elevated Wellness.

4. MEDICAL CLEARANCE. I represent that I am in good physical condition and have no medical conditions that would prevent my safe participation in fitness activities or receipt of clinical services, or that I have obtained appropriate medical clearance for such participation. I accept full responsibility for my own health and safety during participation.

5. GOVERNING LAW. This agreement shall be governed by the laws of the State of Texas. If any portion is held invalid, the remainder shall continue in full force and effect. This agreement is binding upon my heirs, assigns, and legal representatives.

INDEMNIFICATION AND HOLD HARMLESS AGREEMENT

I, the undersigned member/participant, hereby agree as follows:

1. INDEMNIFICATION OBLIGATION. I agree to indemnify, protect, defend, and hold harmless Elevated Wellness Performance & Fitness, LLC and its affiliated entities, officers, directors, members, employees, agents, contractors, clinical practitioners, personal trainers, and all other staff (collectively "Elevated Parties") from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees and court costs) arising out of or in connection with: (a) my participation in any fitness, clinical, wellness, or other activities at the facility; (b) my use of any equipment, products, or services provided by Elevated Wellness; (c) any injury sustained by me or caused by me to third parties while at the facility or in connection with services provided; (d) any misrepresentation made by me regarding my health status, fitness level, or medical history.

2. SCOPE. This indemnification obligation shall apply regardless of the cause of the claim and shall survive the termination of my membership. It applies to claims arising from negligence, except for acts of gross negligence or willful misconduct by Elevated Parties.

< In the event of any claim or litigation, I agree to cooperate fully with Elevated Parties and provide all reasonably requested information and assistance.

4. ACKNOWLEDGMENT. I acknowledge that I have had the opportunity to seek independent legal counsel prior to signing this agreement and do so voluntarily and with full understanding of its terms.

PHOTOGRAPHY, VIDEO, AND MEDIA CONSENT FORM

Elevated Wellness Performance & Fitness, LLC ("Elevated Wellness") may, from time to time, photograph, video record, or capture images of members and participants at the facility located at 7903 S Loop E, Houston, TX 77012, for use in marketing, promotional, social media, website, press, and other business materials.

1. GRANT OF CONSENT. By checking the box below, I voluntarily grant Elevated Wellness Performance & Fitness, LLC and its assigns, agents, and licensees the irrevocable right and permission to photograph, video record, film, or otherwise capture my image and/or likeness while I am present at the facility or participating in any Elevated Wellness activity or event.

2. USE OF MATERIALS. I authorize Elevated Wellness to use, reproduce, distribute, display, and publish such photographs, videos, or recordings in any and all media formats, including but not limited to: websites, social media platforms (Instagram, Facebook, TikTok, YouTube, X/Twitter), print advertising, press releases, television, and any other promotional or marketing materials, without compensation to me.

3. OWNERSHIP. I acknowledge that all photographs, videos, and recordings made by Elevated Wellness at the facility are the sole property of Elevated Wellness Performance & Fitness, LLC.

4. WAIVER. I waive any right to inspect or approve the finished materials or the use of my image or likeness. I release Elevated Wellness from any claims arising from the use of such materials.

5. OPT OUT. Members who do not wish to be photographed or recorded should notify facility staff immediately upon arrival. Elevated Wellness will make reasonable efforts to accommodate such requests. However, Elevated Wellness cannot guarantee that incidental capture in group settings will be avoided.
